Terms and Conditions Climate Pledge

TERMS AND CONDITIONS FOR THE CLIMATE PLEDGE CHALLENGE NOVE MESTO NA MORAVE 2024

1. Scope: These Terms and Conditions apply to participation in the Climate Pledge Challenge Nove Mesto Na Morave 2024 for the BMW IBU World Championships Biathlon Nove Mesto Na Morave 2024 from 7 until 18 February 2024 ("Climate Pledge") on biathlonworld.com/climatepledge ("Website"), which is organized by the International Biathlon Union, Sonystraße 20, 5081 Anif (Salzburg), Austria ("Organizer").

2. Participants: Anyone who is at least 18 years old at the time of participation may take part in the Climate Pledge. Participation shall only be possible personally by each participant. Participations via sweepstake agencies or other third parties who charge a fee for their services shall be excluded. Employees of the Organizer and/or employees of cooperation partners of the Organizer, who are/were involved in the organization of the Climate Pledge, shall be excluded from winning a Prize in the Climate Pledge.

3. Procedure of the Climate Pledge: Participants are asked to select a team that participates at the Biathlon World Championships as their team and then select a pledge or a green action that they plan to commit. Participation in the Climate Pledge is free of charge and is not linked to any purchase of goods and/or the use of services. There is no right to participation. In order to participate in the Climate Pledge, the participant must fill in the mandatory fields in the registration form provided on the Climate Pledge Partner Website (www.pledgeball.org). By entering this mandatory information and submitting their selected pledge the participant’s estimated emissions are counted toward the total emissions saved of their selected team and their information is entered into a random selection draw for the Prize.

The Climate Pledge ends on 18 February, 2024.

4. Prize Determination and Prize: The overall winner will be determined at the end of the Climate Pledge by a random selection draw. In addition, the daily winner will be determined at the end of each day (overall winner and daily winner together "Winner"), also by a random selection draw. Each Winner will receive the prize specified by the Organizer on the Website in connection with the Climate Pledge ("Prize"). The prize stated in connection with the Climate Pledge and the actual Prize are not necessarily identical; deviations (e.g. with regards to design, scope, etc.) are possible. The Organizer will inform each Winner after the end of the Climate Pledge via email to the provided email address. If the contact details provided by the participant or his/her name are incorrect or undeliverable, the draw with regards to this Prize will be repeated, and a replacement winner will be determined. In the event the Winner does not respond to the notification email on the Prize within 7 days, the Organizer may, at its sole discretion, determine a replacement Winner. Prizes will not be paid in cash and are non-transferable.

5. Change, Interruption, Termination, Exclusion: The Organizer reserves the right to change the Climate Pledge and its implementation modalities at any time without prior notice. Participants affected by such changes will be informed immediately in an appropriate manner. The Organizer shall not affect any claims to Prizes already validly and irrevocably accrued by the participants. Furthermore, the Organizer reserves the right to interrupt or completely terminate the Climate Pledge at any time without prior notice, or to extend the Climate Pledge by a reasonable period of time.

6. Liability: The Organizer assumes no liability for lost, damaged, misdirected or delayed entries in the registration form or for any technical difficulties affecting participation in the Climate Pledge. The Organizer, its legal representatives and/or vicarious agents shall only be liable for damages, regardless of the legal reason, in the event of intent or gross negligence or – in this case limited to the contract-typical damage foreseeable at the time of conclusion of the contract – in the event of breach of material contractual obligations. Material contractual obligations are those whose fulfillment are essential for proper performance of the contract, whose breach jeopardizes the achievement of the purpose of the contract and on whose compliance the participant regularly relies. This limitation of liability shall not apply to claims for damages based on injury to life, limb or health or based on other mandatory statutory liability. Apart from that, claims by participants or third parties in relation to the Climate Pledge shall be excluded. In particular, participants of the Climate Pledge are not entitled to any claims (e.g. damages) in the event of changes of the Prize pursuant to clause 4 or to the Climate Pledge itself by the Organizer pursuant to clause 5.

7. Data Protection: The personal data of the participants collected in the context of the Prediction Game will be used exclusively for the implementation of the Climate Pledge, including notification of the Winners and handover of the Prizes. The Winners may be published with their full names. No later than six (6) months after the conclusion of the Climate Pledge, all collected data will be deleted in full, unless a longer storage period is required for contractual or legal reasons. The Winners' data will be stored in accordance with Article 6 (1) sentence 1 lit. c DSGVO due to tax and commercial law retention and documentation obligations in accordance with section 147 (1) of the German Fiscal Code (AO) for vouchers for 10 years and in accordance with section 257 (1) of the German Commercial Code (HGB) for business documents for six (6) years. No further personal data will be processed or used, and will in particular not be passed on to third parties without authorization. Data will only be passed on for advertising purposes with the explicit and express consent of the participants. Each participant may at any time request information about the data stored about him/her and/or may object to the storage and/or use of his/her data with effect for the future and request the deletion or blocking of his/her personal data. The legal basis for the data processing is Article 6 (1) sentence 1 lit. b and f and – in the event of consent – lit. a DSGVO.

8. Applicable Law and Legal Action: The legal relationships between the participants of the Climate Pledge and the Organizer as well as the conditions of participation shall exclusively be governed by the laws of Austria. Recourse through the courts shall be excluded.

9. Severability Clause: Should individual provisions of these Terms and Conditions be invalid in whole or in parts, this shall not affect the validity of the remaining provisions or parts thereof. In the event that a provision is invalid, the parties shall negotiate in good faith to replace such provision by a provision that comes closest to the economic purpose of the invalid provision. The same shall apply with regards to any gap within these Terms and Conditions.
